Scope of application
These General Terms and Conditions (GTC) apply to all inquiries, offers, orders and contracts via the website of ALU-SCAFF S.à r.l. as well as to the resulting delivery of goods.
Deviating conditions of the customer shall only become effective if ALU-SCAFF S.à r.l. expressly consents to them in writing.
Contracting party
The contracting party is ALU-SCAFF S.à r.l., 13, Route de Kayl, L-3385 Noertzange · Luxembourg. Contact: info@aluscaff.lu, +352 26 51 39 70.
Offers and prices
Part of the range is marked with "Price on request". In these cases, we will provide you with an individual offer upon request.
If prices are stated, they are – unless otherwise indicated – net prices plus statutory value added tax (TVA) and, where applicable, plus shipping and packaging costs.
Inquiry and conclusion of contract
The presentation of products on the website does not constitute a binding offer, but an invitation to inquire. You can submit a non-binding inquiry via the contact or inquiry form or by email.
A contract is only concluded through our express order confirmation or acceptance of our offer. You can order non-bindingly via the online shop; payment in advance to our company account is made after order confirmation in accordance with the payment information displayed on the website.
Delivery and shipping
Delivery dates and deadlines are only binding if they have been expressly confirmed in writing. Shipping costs and delivery conditions are stated in the individual offer.
Payment
The payment terms are specified in the respective offer or order confirmation. Unless otherwise agreed, invoices are payable without deduction within 14 days of the invoice date.
Retention of title
The delivered goods remain the property of ALU-SCAFF S.à r.l. until full payment has been made.
Warranty
The statutory provisions on warranty or statutory conformity guarantee under Luxembourg law (Code de la consommation) apply, particularly for consumers.
Right of withdrawal for consumers
Consumers generally have a right of withdrawal for contracts concluded at a distance under Luxembourg law (Code de la consommation). Details, exceptions, deadlines and the model withdrawal form are set out in our separate withdrawal instructions: https://aluscaff.not-live.de/widerruf
Liability
ALU-SCAFF S.à r.l. is liable without limitation in cases of intent and gross negligence as well as for damages resulting from injury to life, body or health. Otherwise, liability is limited to the contractually typical, foreseeable damage.
Applicable law and jurisdiction
The law of the Grand Duchy of Luxembourg applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the consumer's country of residence remain unaffected.
The place of jurisdiction for merchants is Luxembourg City.
Severability clause
Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
