Right of withdrawal

These withdrawal instructions are addressed to consumers within the meaning of the Luxembourg Code de la consommation – natural persons acting for purposes outside their commercial or professional activity.

They apply to distance contracts for goods and services concluded via the website of ALU-SCAFF S.à r.l. (13, Route de Kayl, L-3385 Noertzange · Luxembourg), provided that a statutory right of withdrawal exists.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took or has taken possession of the goods.

For service contracts, the period begins on the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (ALU-SCAFF S.à r.l., 13, Route de Kayl, L-3385 Noertzange · Luxembourg, email: info@aluscaff.lu, telephone: +352 26 51 39 70) by means of a clear statement (e.g. by post, email or using the model form below) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall bear the direct cost of returning the goods. For goods that cannot be returned by normal post due to their nature, you shall bear the direct cost of return at a reasonable amount.

A right of withdrawal does not exist, among other cases, for:

— Goods manufactured to customer specifications or clearly tailored to personal needs (e.g. configured complete scaffolding systems or custom-made products);

— Goods which can deteriorate rapidly or whose expiry date would be quickly exceeded;

— Sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;

— Goods which have been inseparably mixed with other goods after delivery due to their nature;

— Services, if we have fully provided them and only began execution after you expressly agreed and at the same time confirmed that you lose your right of withdrawal upon complete contract performance.

These instructions are based on the provisions of the Luxembourg Code de la consommation (implementation of the EU Directive on Consumer Rights) and the relevant regulations of the European Union.

Mandatory consumer protection provisions of your country of residence remain unaffected.
